Seen this once before and it was defective output electronics on the trunk lid taillight. Had to be replaced as this final output stage electronics is integrated into light housing. This failure was permanent and accompanied by a fault code.
If this has been like this from purchase, documented and also photographed, then dealer should have replaced the light. I would push for goodwill replacement.
