Don't also forget what chassis settings to change. Perhaps it was a calculated gamble by MERC to see what the penalty would be. A clear DNF versus an unknown post race penalty. Worst case would have been a DQ which would equal a DNF.
End result was better than allowing failure. Betting there will be all types of "illegal" communication now that the penalty is known.
FIA will need to up their game next time.
