How many miles does the car have today? Also, document every visit (more info, the better) to build your case. I believe you can start filing lemon after the 10th visit, but check your state law.
The N63 and oil burning is a hit or miss issue. I bought mine at 10k miles, I now logged 32k miles on it w/o ever filling oil. I change my oil between the recommended interval as well, it's not required but it makes me feel better. Others are not so lucky, having to go through a quart every 2-5k miles for the first 30k miles. After 30k miles, the rings should start sealing properly.
