Question for a Friend: Water ruined 750li engine?

I've never run into this situation before but this just happened to a friend this week so I thought I would ask because he's not sure what to do.

We've had a torrential downpour in the DFW are the last few weeks and Sunday night he was driving home in his 2006 750li and there was an area where there was water and all the cars in front were driving through no problem so he proceeded and he said his car stalled out (no water came into interior).

He got it towed and the dealer says the engine is shot. They said that there is a front intake on the car that ingested water and it totalled the engine.

He said even as he sat there in his car, cars behind him like Toyotas drove through with no problems.

First, this is car he bought low mileage, one previous owner, BMW certified, with an extended warranty through 100,000 miles, so how should it be fixed so the title will not be affected and so it will affect the value in the least damaging way? Of course his insurance company wants to fix it on the cheap.

Second, is this a design oversight on BMWs part and is this a problem on other BMWs? My wife has a 2008 328i convertible so I'm curious if this is a potential issue on her car as well.
