Can Broken Turbo Inlet Tube cause turbo failure (dealership says no)

I have a 2013 750Li I have owned 9 years (80k miles, immaculately maintained), all service at dealership. My drivers side turbo failed immediately when driving away from dealership after extensive work was done on engine (valve stem replacements, engine rebuild). They kept saying it could not have been caused by work they did and stated needed expensive turbo replacement and timing was coincidental and just 'worn turbo.'

I had it towed to specialist for second opinion and they found that the turbo inlet tube flange is broken on that side, the holding bolt missing and tube not in anyway secured to the turbo. They felt this caused the failure. Sent pictures back to dealership and they are saying they see the inlet tubes broken on many BMWs, that is reason they did not disclose it to me or state it needed repaired, would not say whether break was by them, but that regardless of if they broke it or not, that this cannot cause a turbo failure.

The drivers inlet tube is covered in thick dirt and grime compared to secured passenger side, to me this implies dirty air flow into the turbo for long period of time. Dealership saying they are not at fault even if they broke the tube and I just have to pay for the worn turbo replacement.

Does this sound right to you? What do you suggest to do?
