Yeah, good luck with winning a civil suit against anyone for an on track incident. Even if they got the most successful lawyer out there, chances of winning are slim to nill. Winning a civil suit for a track event sets up the wrong precedence which would destroy track and sanctioned racing events. No one would push their vehicles for fear of being held monetarily liable for anything that happens.

I don't know if you've ever been to any track events. If you haven't, you will understand why many of us who have are taking this stance. You know the risks. If you don't want to put your car at risk, don't put it on the track.

And I only used my example of insurance companies to emphasize being on track isn't something that is deemed as a normally accepted risk.

Of course they can/will/should! This is also commonplace when Track/Course Racing. You, the Driver are still liable and consent to as such. Sucks to be him. What is reeeeeally interesting is how if any can the Porsche claim on Insurance for his 911 or the damage he caused...

Realistically the guy with the Huayura is at fault..... If you got money like that you can surely afford to close the track for the day and be the only one out there

It's more of a gentleman's agreement.

If I would were to smash my race car against another car I don't have to pay a cent. However that would be in poor taste and the NASA heads probably wouldn't be too willing to have me back.

But that's the risk, it's not a cheap hobby. Best to accept that early.

The Pagani was actually a mule and that was a test driver. The door popping open is allegedly an intended safety feature in a crash.
